A division bench of Justice Anil Pansare and Justice Sunil Shukre has warned the Chief Executive Officer of very strict action if he fails to appear in person in its court.
Chandrapur: The Nagpur Bench of the Bombay High Court has summoned Mithali Sethi, the Chief Executive Officer of Chandrapur Zilla Parishad, on November 30, on a petition alleging irregularities in giving the compassionate job to a dialysis patient.
A division bench of Justice Anil Pansare and Justice Sunil Shukre has warned the Chief Executive Officer of very strict action if he fails to appear in person in its court.
Its primary teacher under Zilla Parishad, Chandrapur District, Gajanan Uplanchiwar, died in the year 2009. And along with this, his wife Sangeeta has also applied to give her own eldest son Aditya a job on compassionate grounds soon.
According to its petitioners, Aditya’s name was in the waiting list in the year 2009 as well. But Aditya was not given a job at all till the year 2014.
Meanwhile, Aditya had to face a very dangerous disease. Due to which both his kidneys had completely failed in the year 2013-14. He is also taking regular dialysis treatment since then and then he could not even do his education.
Despite Repeated Requests
In the year 2014, Sangeeta had prayed that her second son, Dhruv, be given this job, but he was only about 15 years old then. The petitioners have said that the Zilla Parishad administration had assured them of early admission at the age of about 18 years and then their names were also put on the waiting list.
In the year 2017, Dhruv has turned 18 years old, but the petitioners have said that despite many requests, his name was not included in place of Aditya near the year 2020. And then after that, his name was removed and then his job claim was also completely rejected saying that the rules in this regard have been changed to the date of 20th May 2020. And because of this, Aditya’s name cannot be changed at all, the petitioners said.
Advocate Arvind Waghmare, appearing for these petitioners, has submitted that Dhruv’s application was filed before this rule was changed. And also pointed out that the HC had already quashed similar proceedings by passing 2 judgments outright.
Dhruv and Sangeeta had filed the petition in the month of March, after which this notice was issued by the High Court in the month of August. But the Zilla Parishad had already issued an order to appoint Aditya in the month of July.
When the HC sought clarification, the Zilla Parishad had neither given any reply. And at the same time, his lawyers also did not appear before the court. Additional Public Prosecutor whose name is Shishir Ukey gave this brief for the state.
