HC fines man Rs 1 lakh for plea against police

Irshad Khan Iqbal Khan, a resident of Wani's also Sai Nagar, is a coal trader. And while stealing coal, he is caught by the Shirpur police.

Yavatmal: A person accused of stealing coal by the police has been fined one lakh rupees for filing a writ petition with malafide intention, to pressurize the police officers to take action against him.

Irshad Khan Iqbal Khan, a resident of Wani’s also Sai Nagar, is a coal trader. And while stealing coal, he is caught by the Shirpur police. Along with this, Head Constable Haribhau Surpam also lodged an FIR against Irshad Khan in the year 2021. And Shirpur police had registered a criminal case against him under sections 379 and 34 of IPC.

Irshad Khan had approached the Wani Adalat to quash the FIR. And in the meantime, he had also filed a writ petition demanding Rs 10 lakh each from the complainant Soorapam and the SHO as compensation for the false FIR lodged against him by the police.

Court ordered the petitioner Irshad Khan to pay around Rs one lakh to the Police Welfare Fund

This was done even when his case was fully pending in the Wani Court. He had also alleged that the police had also registered a criminal case against him on personal enmity.

The matter was heard by a bench of Justice Rohit Dev and Justice Anil Pansare. And along with this, Shirpur’s PSO Gajanan Karewad had also filed an affidavit in the court on behalf of the state. And at the same time, the court had completely rejected Irshad’s petition and also said that it has given priority to the criminal writ petition to pressurize the government servants on duty.

The court has also ordered the petitioner Irshad Khan to pay around Rs one lakh to the Police Welfare Fund through challan within about 15 days from the date of the pronouncement of the verdict.
