High Court canceled the allotment of land of Nagpur Improvement Trust to the private society

Petitioner Malvi Suvarnakar Sanstha, through advocate Anand Parchure, had approached the court challenging the decision of the Nagpur Improvement Trust to allot Plot No. 8 (Khasra No. 538) in its layout at Manewada.

Nagpur: The Nagpur Bench of the Bombay High Court has set aside the 2017 GR of the Urban Development Department (UDD) relating to the allotment of Nagpur Improvement Trust (NIT) land to a secret society.

Petitioner Malvi Suvarnakar Sanstha, through advocate Anand Parchure, had approached the court challenging the decision of the Nagpur Improvement Trust to allot Plot No. 8 (Khasra No. 538) in its layout at Manewada.

The petitioner has also stated that Plot No. 6 and No. 7 have already been allotted to the respondent Teli Samaj Sabha in the same layout. The petitioner has also claimed before the court that “monopoly is about to be established by allotting all the three plots to the said community”.

Merely on the basis of a request made in the form of the letter

The petitioner also said that the land disposal rules of Nagpur Improvement Trust had not been followed at all in the allotment of land.

The bench headed by justices AS Chandurkar and Anil Pansare has also said so in its order that despite similar demand, the urban development department “allotted Plot No. 8 dated June 9, 2017, to respondent No. 3 under impugned GR – Also Shri Santaji Jagnade Maharaj Smarak Samiti, a society belonging to Teli community, for the management, maintenance, and repair of the community hall to be constructed thereon.

The Court has also said that Plot No. 8 had been allotted to Shri Santaji Jagnade Maharaj Smarak Samiti, “Merely on the basis of a request made in the form of the letter without assigning any cogent reasons and without disclosing the special circumstances or special nature of the case for allotment of the said plot, Without following the procedure prescribed under Rule 5(2) of the Land Disposal Rules.”
