Nagpur man gets death sentence for raping two daughters
The elder daughter had also complained that the man started raping her a fortnight after her mother's death during the delivery of her youngest brother.
Nagpur: A 38-year-old autorickshaw driver has been sentenced to life imprisonment after being found guilty of raping his minor daughters, aged 14 and 13, for a prolonged period. And the court has also imposed a fine of around ₹5,000 on the three family members for completely failing to report the crime after becoming aware of it.
The elder daughter had also complained that the man started raping her a fortnight after her mother’s death during the delivery of her youngest brother. The rest had three more siblings. The man had also continued raping two daughters between June 2019 and November 2020, despite having remarried, before the case was registered at the Tehsil police station.
After raping the elder one for about a year, the father started raping the younger sister as well before this was revealed. Rashmi Khaparde, additional public prosecutor and special counsel under the Protection of Children from Sexual Offenses Act, 2012, said that around 14 witnesses had been examined. “Both the sisters had given strong statements before the court along with one of their relatives with whom they had shared their plight,” Special PP said.
The Special Court had already convicted the person under Section 376(2)(j)(n)(f) of the IPC, But according to the order of section 42, the punishment has been given under POCSO. Because the special law had a more severe punishment.
Holding three relatives of the rape victims responsible for failing to report
The court also ordered the District Legal Aid Service (DLAS) to distribute the fine amount among the rape victims and ensure their rehabilitation and further education.
Under Section 4(2) of the POCSO Act, 2012, Special Judge OP Jaiswal has sentenced the father to rigorous life imprisonment till his last breath. And also similar declarations under Section 6 of the Act had been made for the accused for aggravated penetrative sexual assault.
The special court has also sentenced the culprit to imprisonment for about three years and a fine of one thousand rupees under Section 8 of the POCSO Act. He had already been sentenced to imprisonment for about five years under Section 10 of the Act. And at the same time, the court has also sentenced the father to rigorous imprisonment of about three years and a fine of Rs 1,000 for threatening the daughters of dire consequences if they tell their ordeal.
Also, holding three relatives of the rape victims responsible for failing to report the matter to the police immediately after learning about it, the special court imposed a fine of Rs 5,000 on them. And the court has also asked them to remain in the court till the working hours are over.
