Nagpur: Continuing its tough stand on all those filing frivolous (PIL) Public Interest Litigation. The Nagpur City Bench of the Bombay High Court has imposed a fine of Rs 10,000 on former deputy mayor. And sitting Bharatiya Janata Party corporator named Satish Hole for misusing the judicial apparatus to fulfill his personal agenda.
Bharatiya Janata Party councilor Satish was the deputy mayor of this city in the year 2016.
A division bench of Justice Anil Kilor and Justice Sunil Shukre has observed that this step of the petitioner very clearly reflects this personal agenda behind the mask of public interest. If such a move is in any way encouraged by this Court. So this will greatly harm the interests of all the people. Therefore such a trend should be discouraged. Rather, it should be completely eliminated from the very beginning.
Before the judges dismissed the Public Interest Litigation, it has been said that we have found that this petition has not been filed in good faith.
Apart from this, while directing the corporator of South Nagpur to deposit this fine amount with the High Court Legal Services Sub-Committee within about two weeks. The bench has asked its registry to place this petition. Before it for the most urgent coercive order in case of failure to comply with the order.
Parking System For Vehicles
Satish, who works with the Nagpur city university, had also moved the HC to give directions to the respondents, including the NMC. So that proper parking arrangements can be made for all vehicles in the National Gandhi Market located inside Sakardara. City survey no. 148 in Zone No. 2 and 83 in Zone No. 1, keeping many shops empty.
Satish, through advocate named Vilas Waghmare, has made a demand to the Nagpur Municipal Corporation to restrain the concerned bidders from allotting vacant shops and vending platforms on the basis of the notice of e-tender.
The bench has said that the petitioner, in the name of removing the inconvenience of all the people. Now it looks like it is just pushing its own agenda. Otherwise they would not have made any such request to give directions to the respondents. Whenever we pay attention to this prayer. Then a firm belief is created in our mind that there is some hidden agenda behind the filing of the petition.
The judges have also held that the vending platforms and unused shops are all legal constructions created by the Nagpur Municipal Corporation. And therefore all have every right to deal with them in order to serve the public interest. And because of this some income will also be earned. But these petitioners do not see any major public interest in any such action. The petitioners are bent on stopping the e-auction on the pretext of providing adequate parking space inside the National Gandhi Bazar.
