Pending increased by 868 in family court, cases of mutual divorce increased

Nagpur: Even though there has been a significant reduction in the admission of new cases related to family disputes during the coronavirus pandemic, But in the last almost three years, the number of cases pending in the family court here has increased.

In response to an RTI, the superintendent of the court has also stated that there were around 7,995 cases pending in the year 2020. And by the end of the year 2021, this number has increased and has increased to 8,863.
Which is a jump of 868 cases. The number of pending cases in the year 2019 stood at 7,304.

On the other hand, the registration of cases has also come down significantly in the last almost three years. While 4,028 cases were registered in the year 2019, In the year 2020, this number has decreased and has come down to 2,345 and in the year 2021, it has become 3,263.

Blaming this trend entirely on the pandemic-induced lockdown of covid, Court officials have said that the litigants did not approach the family court and because of this, the registration of its new cases has come down significantly.

Family Court deals with matters

Since the courts were handling urgent matters only during the peak of the pandemic, The increase in pendency was also certain. A similar phenomenon was observed in all the courts of the country during the period of a covid pandemic from March 2020.

In response to questions from senior RTI activist Abhay Kolarkar, The superintendent has said that there has also been an increase in the cases of mutual divorce, But there has also been a huge jump in filings. In the year 2017, 645 cases have been registered Which has increased to 787 last year. Whereas in the year 2017, 337 were pending, Which has increased to 478 in the year 2021.

The superintendent has also said that out of 78 vacant posts, four have not been filled at all. These include the deputy registrar, two sweepers and the watchman. Family Court is working with full force which includes a principal judge and three other judges, a court manager, a registrar, 8 marriage counselors and others.

The Family Court deals with matters relating to Streedhan, Child Custody, Maintenance, and separate matters under Section 13B and Section 125 besides maintenance and divorce by mutual consent.
